It can be really hard to tell if an image is protected or not. It should then be your problem to find out if it is or not. As strange as it sounds. Reasonably, it should be in the image agency's and the photographer's interest to protect this. They can do that very simply.

1. One can watermark the image.
2.  One can write in a corner of the image "copywrite". Does not need to be seen much and you know immediately that the image is protected.
3. One can provide the image with a small script that makes it impossible to download. Most of the time, a hand waves you bye.

You will know immediately that the image is not available and the only way to use the image is to buy a license.

It would be the only common sense thing on the market to avoid mistakes. Why is imnte done this!

There is an almost criminal ulterior motive from the image agencies and photographers that prevail in the market. If you post a picture on the internet without having done a full check, the image agency jumps right at you and demands damages. Then it doesn't matter that you immediately take down the picture, but you have infringed and must pay. In other words, both the photo agency and the photographer benefit from as many people as possible posting the image without a license. Then they immediately jump on you and demand you for damages. Then whether you take the picture down, or maybe even have done so, is irrelevant. You must pay damages anyway!!! Scandalous action!!

You can buy goods online, and have a statutory right of withdrawal or replacement. In this case, the legal right is put out of play.

We have recently been affected by such an action by a rogue image agency. They say that they protect the photographer's right to their images. No one has denied this, but it must be done in the right ways and not this criminal behavior!
